1. NOTICE IS HEREBY GIVEN that the undersigned Trustee will on the 9th day of December, 2022, at the hour of 10:00 a.m., at the Yakima County Courthouse, on the front steps of the first floor, in the City of Yakima, State of Washington, sell at public auction to the highest and best bidder, payable at time of sale, the following described real properties situated in the County of Yakima, to wit:

which is subject to that certain Deed of Trust, dated April 22, 2011, and recorded on April 20, 2011, under Auditor’s No. 7726203, records of Yakima County, Washington, whereby Grantor, Patricia Carrillo, secured an obligation in favor of Beneficiary, Jerry Bush.

2. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Grantor’s default on the obligation secured by the Deed of Trust.

3. The default for which this foreclosure is made is as follows:

a. Failure to pay the following amounts which are now in arrears:

Monthly payments in the sum of $700.00 from June, 2016 through September, 2022 in the total sum of $53,200.00 together with delinquent fees in the sum of $35.00 per month or the total sum of $2,625.00.

b. Real estate taxes and assessments:

2014: $1,592.92 plus accruing interest and penalties

2015: $2,246.78 plus accruing interest and penalties

2016: 1,986.39 plus accruing interest and penalties

2017: 1,667.94 plus accruing interest and penalties

2018: 1,954.86 plus accruing interest and penalties

2019: 1,671.35 plus accruing interest and penalties

2020: 1,980.93 plus accruing interest and penalties

2021: 1,598.23 plus accruing interest and penalties

2022: 1.545.69 plus accruing interest and penalties

Total $16,245.09

c. Other charges:

Publication Fee (estimate) 500.00

4. The sum owing on the obligation secured by the Deed of Trust is: Principal Balance $60,022.14, together with interest at the rate of three and one-half percent per annum (3.5%) from the 22nd day of June, 2016, and such other costs and fees as are due under the Note or other instrument secured, and as are provided by statute.

5. The above-described real property will be sold to satisfy the expense of sale and obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied regarding title, possession, or encumbrances on the 9th day of December, 2022. The default(s) referred to in paragraph 3 must be cured by the 29th day of November, 2022, (eleven [11] days before the sale date) to cause a discontinuance of the sale. The sale will be discontinued and terminated, if at any time on or before the 29’h day of November, 2022, (11 days before the sale date) the defaults as set forth in paragraph e, together with any subsequent payments, late charges, advances, costs and fees thereafter due is/are cured and the Trustee’s fees are paid. The sale may be terminated any time after the 29th day of day of November, 2022, (eleven (11) days before the sale date) and before the sale by the Grantor or the holder of any recorded junior lien or encumbrance paying the entire principal and interest secured by the Deed of Trust, plus costs, fees and advances, if any, made pursuant to the terms of the obligation and/or Deed of Trust.

6. A written Notice of Default was transmitted by the Beneficiary or Trustee to the Grantor by US mail, first class and certified on May 20, 2022, said Notice being mailed to the address shown on the recorded document as that of the Grantor at the following address: 1201 S. 96th Avenue, Yakima, Washington, proof of which is in the possession of the Trustee. A written Notice of Default was posted in a conspicuous place on the above described real property on May 20, 2022. Proof of which is in the possession of the Trustee.

7. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it, a statement of all costs and fees due at any time prior to the sale.

8. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above-described real property.

9. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130. Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee’s sale.

NOTICE TO OCCUPANTS OR TENANTS

10. The purchaser at the trustee’s sale is entitled to possession of the property on the 20th day following the sale, as against the grantor under the deed of trust (the owner) and anyone having an interest junior to the deed of trust, including occupants who are not tenants. After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under chapter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW61.24060.
